Terms and Conditions for EmailBits

1. Introduction

Welcome to EmailBits, operated by Ignite Bright, LLC ("we," "us," or "our"). By accessing or using the Service at https://emailbits.co, you agree to be bound by these Terms of Service. If you disagree with any part, you may not access the Service.

2. Description of Service

EmailBits provides a platform for browsing, editing, and generating HTML email templates and components. The Service includes:

- A library of free and premium HTML email templates and components
- A Basic Editor for customizing templates
- An Advanced Editor with drag-and-drop functionality, reusable blocks, revision history, and custom tokens (Pro Features subscription required)
- AI-powered template generation using credits (Pro Features subscription required)
- Brand Kit with automatic brand detection (Pro Features subscription required)
- A Custom Email Design service where our team creates bespoke email templates on your behalf
- The ability to save favorites, fork templates, create your own templates and components, and submit community templates for review

3. User Accounts

Certain features require an account. You may register using a magic link (email) or Google OAuth. You are responsible for maintaining the confidentiality of your account and all activity that occurs under it. Notify us immediately at support@emailbits.co if you suspect unauthorized use.

4. Plans, Payments, and Refunds

4.1 Pro Templates — $49 one-time purchase
Grants lifetime access to all premium templates and the Basic Editor. No recurring charge.

4.2 Pro Features — $9/month subscription
Grants access to the Advanced Editor, AI template generation (starter credits included), Brand Kit, custom tokens, and revision history. Billed monthly. You may cancel at any time; access continues through the end of the current billing period.

4.3 AI Credits
Additional AI generation credits may be purchased as one-time top-up packs. Credits are non-refundable once consumed. Credits do not expire while your Pro Features subscription is active.

4.4 Custom Email Design Service
One-time or monthly retainer packages where our team designs custom email templates for you. Deliverables, revision limits, and timelines are as described on the checkout page at time of purchase.

4.5 Refunds
One-time purchases (Pro Templates, AI credit packs, Custom Email Design) are eligible for a full refund within 7 days of purchase, provided the deliverables have not been fully delivered or credits have not been consumed. Monthly subscription charges are non-refundable except where required by law. To request a refund, contact support@emailbits.co.

4.6 Billing
All payments are processed by Stripe. We do not store your full payment card details. By completing a purchase you agree to Stripe's terms of service.

5. Licensing and Intellectual Property

5.1 Template License
Upon purchase of Pro Templates, we grant you a non-exclusive, perpetual, commercial license to use the HTML and JSX source code of premium templates and components to create email campaigns, client deliverables, and internal tools. You may not:
- Resell, sublicense, or redistribute the raw template source code as a standalone product
- Claim authorship of the original templates
- Use the templates to build a competing template marketplace

Free templates are licensed under the same terms at no charge.

5.2 AI-Generated Content
Content generated by the AI template feature is owned by you, subject to the limitations of the underlying AI provider (Anthropic). We make no warranties regarding the originality or fitness of AI-generated output.

5.3 User-Submitted Templates
If you submit a community template for review, you grant Ignite Bright, LLC a non-exclusive, royalty-free license to display, distribute, and feature that template on the platform. You represent that you own the rights to submitted content.

5.4 Platform Ownership
The Service, including its design, codebase, and original template library, is owned by Ignite Bright, LLC and protected by applicable intellectual property laws.

6. User Conduct

You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Infringe any third-party intellectual property, privacy, or other rights
- Attempt to gain unauthorized access to any part of the Service, its servers, or connected systems
- Scrape, crawl, or systematically download template content beyond normal use
- Use AI generation credits to produce content that is harmful, misleading, or violates applicable laws

7. Termination

We may suspend or terminate your account at our sole discretion for any violation of these Terms, with or without notice. Upon termination, your license to access premium content ends. Refund eligibility is governed by Section 4.5.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that templates will render identically across all email clients.

9. Limitation of Liability

To the maximum extent permitted by law, Ignite Bright, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

10. Governing Law

These Terms are governed by the laws of the United States and the state of Delaware, without regard to conflict of law provisions. Disputes shall be resolved in the courts located in Delaware.

11. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email or a notice on the Service. Continued use after the effective date constitutes acceptance of the revised Terms.
